Qualified plans must demonstrate “fairness” through compliance with the coverage tests of IRC §410(b) and the non-discrimination rules of IRC §401(a). This session will use case studies to illustrate proactive plan designs and testing approaches that lessen the chance of a failure. Alternative methods of testing will be illustrated as well as potential correction options. Attendees will learn about:

•  Strategic plan designs and methods to detect and avoid compliance traps;
•  Operational testing options (including plan aggregation and permissive dis-aggregation); and
•  How to correct testing failures.
